Common mistakes that can hurt a personal injury claim

Virginia residents who get into accidents that are not their fault may be left with injuries. In that situation, it’s logical to file a personal injury claim. Avoid making these common mistakes that can hurt your case.

Not immediately seeking medical attention

Regardless of the type of accident that led to your injuries, if you procrastinate on getting medical attention, it can adversely affect your claim. If you filed a claim with the at-fault party’s insurance company, the fact that you didn’t get medical care timely can be held against you.

Giving a recorded statement or signing something

Insurance companies strive to avoid paying injured victims or try to pay them the smallest settlement possible. If an adjuster asks you to give a recorded statement or sign a document, it’s a mistake that can hurt your claim. Politely decline to do either. Usually, when you’re asked to sign something, it’s a waiver or agreement to a lowball settlement offer.

Posting on social media

While you have a claim pending, one of the biggest mistakes you could make is to post on social media . Even if you think you’re posting something innocent, anything can be misconstrued and used against you in your case. It’s best to avoid social media altogether until after your case is settled.

Not documenting the accident scene

You should always document the scene. Photos, witness statements and police accident reports are all valuable evidence. Without these things, your case can suffer. Whether your claim is against an insurance company or the at-fault party, evidence is needed to show that your injury is, indeed, legitimate. Witness statements and pictures can strengthen your case.
